AREGA Pharma BV/SRL, registered with company number 0722.544.585, with registered office at Laarstraat 16, B 2610 WILRIJK (hereinafter “Arega”, “we”, “us”) is committed as controller to comply with applicable legislation on the protection of personal data, including but not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with data protection regarding the processing of personal data and the free movement of such data, and repealing Directive 95/46 / EC ("GDPR"), as well as any applicable national legislation implementing it ("Applicable Data Protection Law").

In this privacy statement for applicants of Arega (hereinafter "Privacy statement") we explain how we process your personal data when you (hereinafter “applicant”, “you” or “your”) apply for a position at Arega, what your rights are and how you can exercise them. If you have any questions after you have read this privacy statement, please contact us using the contact details in Title 7 below.

For the application of this privacy statement, notions such as “personal data”, “processing”, “processor” and “controller” shall have the meaning assigned to it under Applicable Data Protection Law.

Retention periods

-          Your personal data are in principle removed or anonymised if you are not selected for a position at Arega

-          Your personal data are however retained for a period of 1 year after the interview in case you are not selected for a position at Arega, if you have provided your consent for the retention in order to contact you for possible future recruitment.

If you are recruited as an employee at Arega, we will provide you with the employee privacy statement that contains additional information about all processing operations in this regard.

Please note that where the processing of personal data is a legal or contractual requirement, the refusal or inability to provide this personal data may prevent us from considering you as a candidate for a position or entering into an employment contract with you.

Title 3. Recipients

As also clarified in the schedule above (Title 2), for the purposes specified above, your personal data may be shared with:

  • Authorized personnel of Arega (including employees and external consultants), professional advisors and agents with a “need to know” the personal data;
  • Authorized service providers and processors that help us manage our activities;
  • Affiliate companies of the Arega-company group, including Arega Health BV/SRL, with registered office at Laarstraat 16, 2610 Antwerp, company number 0721.744.435 and Arega Medical BV/SRL, with registered office at Laarstraat 16, 2610 Antwerp, company number 0728.941.538;
  • Buyers or potential buyers of (a part of) the activities of Arega (and their professional advisors);
  • Governmental, regulatory and law enforcement agencies, if required for the purposes specified above, if legally required, or if required to protect our legitimate interests in accordance with applicable laws, including Applicable Data Protection Law.

Title 4: Rights of the applicant

If and insofar as applicable and in any case in accordance with the Applicable Data Protection Law, the applicant can exercise the following rights with regard to the processing of his personal data by Arega:

4.1. Right of access (art. 15 GDPR)

The applicant has the right to receive information about whether or not personal data is processed about him and, where this is the case, to receive a copy thereof and to receive specific information about this processing.

4.2. Right to rectification (art. 16 GDPR)

The applicant who finds his personal data to be incorrect can immediately request Arega to correct this. If the applicant finds incomplete personal data, he can immediately request completion, including by making an additional statement.

4.3. Right to erasure (“right to be forgotten”) (art.17 GDPR)

The applicant has the right to request erasure of his personal data in the following cases, inter alia:

  • The personal data are no longer necessary for the purposes for which they were collected or processed;
  • The applicant withdraws his consent for the processing and there are no other legal grounds for the processing;
  • The applicant objects to the processing and there are no overriding legitimate grounds for the processing;
  • The personal data have been unlawfully processed.

4.4. Right to restriction of processing (art. 18 GDPR)

The applicant has the right to obtain restriction of processing in the following cases, inter alia:

  • When the accuracy of the data is contested by the applicant, for the time required by Arega to verify the accuracy of the personal data;
  • The processing is unlawful, the applicant does not want erasure of his personal data but a limitation of the use of the personal data;
  • Arega no longer requires the personal data, but the applicant needs them for the lodging, exercise or defense of legal claims;
  • When the applicant has objected to the processing pending verification whether the legal grounds for processing of Arega override that of the applicant.

4.5. Right to data portability (art. 20 GDPR)

The applicant has the right to obtain the personal that have been processed by Arega in a structured, commonly used and electronically readable form. He also has the right to transfer this data to another controller under the conditions of Applicable Data Protection Law.

4.6. Right to object (art. 21 and 22 GDPR)

The applicant has the right to object to the processing of his personal data due to his particular situation. The applicant has the right to object to the processing of his personal data for direct marketing purposes, which includes profiling to the extent that it's related to such direct marketing.

4.7. Right to submit a complaint and to withdraw consent

The applicant has the right to lodge a complaint with the Data Protection Authority if he considers that the processing of his personal data infringes Applicable Data Protection Law.

The applicant has the right, if the processing is based on consent, to withdraw consent without prejudice to the lawfulness of the processing based on consent prior to withdrawal.

Arega will handle requests to exercise the above rights in accordance with Applicable Data Protection Law.

Title 5 How long do we retain your personal data

In accordance with Applicable Data Protection Law, your personal data will be kept for as long as we have a legitimate business need to process it, for example, to consider you as a candidate for a specific position or to conclude an employment contract with you.

When we no longer have a legitimate business interest to process your personal data and there is no legal requirement for retention, we will either anonymize or delete it, or if this is not possible, we will securely store your data and isolate it from further processing until removal is possible.

The retention periods for specific processing activities can be found in the schedule above (Title 2).
